“I have a Question about Tips for a Safe Lease Agreement on a House”?
Hi:
I just found what it seems to be the perfect house for me and my family, the problems is that the person renting the house “my future landlord” is not the owner of the house, he told me he has a Power of Attorney that allows him to rent it. I was a little surprised because at first he told me that he was the owner, so i went back home and did some research and found out he was not the owner. Besides that, he also wants to get the 1st month of rent, the last months and the security deposit in CASHHHHHH.
What should i do?, What is the right thing to do in order for me to be on the safe side?
I`m just trying to have the safest possible lease agreement, i`m trying to avoid a scam.
I`d really appreciate your advice on this one.

I would first get in touch with the actual owner, or at the very least, ask to see a copy of the power of attorney document. If he actually is a POA…he must, by law, have a copy of this.
Your scenario reeks of scam.

Actually there are different types of Powers of Attorney some are good for only a specific time and some for specific purposes. In order for this person to have the same rights as the owner he must have received what is know as a Durable Power of Attorney – It gives the person designated to every right the person who signed the POA has i.e. banking accounts, buying, selling, etc. and there is no time limit. If this person does not have the Durable POA he has limited control over the owner’s business and I would not rent under those circumstances.Contact the owners if you know how to reach them and be positive of the kind of POA this man has.
